In this terms and conditions document as well as in our privacy policy and our disclaimer, the following terminology applies: “customer”, “client”, "student", “you” and “yours” refer to you, the person accessing our website and accepting the terms. “The company”, “ourselves”, “we” and “us” refers to Deutschable (Stephan Brenner, Inhaber) or "Deutschable" for short, natural person owning the Deutschable brand and its products. “Party”, “parties” and “us” refers to both the customer and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the customer in the most appropriate manner. Any use of the above terminolgy or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. These Terms & Conditions are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms & Conditions shall be resolved in the courts of Berlin, Germany.

Refund Policy for all self-study courses

These are the terms concerning refunds for our customers:

  • In the event that you are not happy with a product you purchase from Deutschable, you are protected by a 30 day money back guarantee.
  • If you ask for a refund beyond 30 days after the initial purchase date of the product then you will not be granted a refund and there are no exceptions to this rule.
  • To prevent abuse, by asking for a refund you agree that your current access to the product will be terminated immediately and repeat or future purchases (even using a different email or payment method) from Deutschable.com, especially of the same product, may be refused or terminated without notice.
  • Refunds are made via Stripe/ThriveCart/Paypal and will processed within 3 business days of the refund notice.

Privacy Statement

We are committed to protecting your privacy. Any information collected from individual customers is processed exclusively on a need-to-know basis. Please see our full privacy policy on all details concerning your privacy, while using our website.

Confidentiality

Any information concerning the customer and the respective customer records are regarded as confidential and will therefore not be divulged to any third party, unless we are legally required to do so by the appropriate authorities. Customer data is passed on only to services required to maintain our business, such as payment processors (Stripe, ThriveCart, others). These third party services guarantee the privacy of your data in their own terms. Customers have the right to request sight of and copies of any and all customer records we keep, on the provisio that we are given reasonable notice of such a request. We will not sell, share or rent your personal information to any third party or use your email address for unsolicited mail. Any mails sent by Deutschable will only be in connection with the provision of agreed services and products.

Payment

Payments are processed through third-party payment providers like Stripe and ThriveCart, to insure the best possible customer experience and ensure the customer’s privacy. Site a instructions are sent by email, after the payment is received. Please take care to spell your email address correctly when making the purchase and please be sure to check your spam folder in case you don't receive an email after payment. Additional charges, late fees, chargeback fees and other fees are determined by our payment providers.

Discount Policy

On occasion, Deutschable may offer purchase incentives in the form of subscription discount codes. Discount codes are only valid for the period indicated. Unless otherwise noted, discount codes lose their validity on the last day of the calendar year. 

Cancellation and Refund Policy

Any subscription services maybe be cancelled by the customer at any time. Customers can cancel their subscriptions through the payment provider, in their user account on Deutschable or by contacting us via email or our contact form. A minimum of 24 hours notice of cancellation is required. All our products come with a 30 day refund guarantee. Customers can request a refund by sending an email or using the contact form. Refunds are only granted within 30 days of the original payment. Refund requests that reach us outside of 30 days or refund requests for subsequent billings of a subscription (all payments after the first payment) will not be granted. Both the customers and ourselves have the right to terminate/cancel for any reason.

To prevent abuse and protect the security integrity of user accounts and user data, if a particular user logs into the site with an average of 20 times or higher per day over the course of at least 5 days, the account may be suspended until the issue has been resolved.

Exclusions and Limitations

The information on this site is provided “as is”. To the fullest extent permitted by law, the company excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the company’s literature. Terms & Conditions for Live Language Lessons with a Private Teacher

1. Introduction

These Terms & Conditions govern the provision of private German language lessons by a qualified teacher as provided by Deutschable. By purchasing and participating in these lessons, students agree to the terms outlined herein.

2. Lesson Bundles

  • Purchase: Lessons can be bought in bundles on the sales page to guarantee a certain price. Lesson units can not be purchased individually outside of these bundles.
  • Lesson Units: Bundles contain a set amount of lesson units, each lasting 45 minutes.
  • Booking: Meetings are booked either as one or in multiples of these 45-minute lesson units. Fractions of units (i.e. 60 minute lessons) are not possible.

3. Scheduling and Conduct of Lessons

  • Meeting Platform: Lessons are conducted online, typically via Google Meet, though other software (i.e. Zoom, Skype, etc.) can be used if agreed upon in advance.
  • Scheduling: Meeting times and days are mutually agreed upon via email in advance by both the teacher and the student. Such meetings must be arranged and confirmed in writing by the primary student (unless otherwise specified in writing, the primary student is the person in whose name the invoice was issued). Since teacher availability is limited, lesson times are allotted on a first-buy-first-serve basis. Should no initial lesson happen within four weeks of purchase, student may receive a 100% refund.
  • Prerequisites: Students must be able to speak English, over 18 years of age, and whose German level is below C1. Additionally, students must have an internet-capable device, stable internet connection, a quiet and non-distracting area for the lessons, a working web cam and microphone, and the capability and know-how to test each of them before the session. If a session must be cancelled due to heavy distractions or technical issues on the part of the student, the session's units are considered void and forfeit.

4. Participation of Two Students

  • Primary Student: The primary student, in whose name the invoice is written, may invite a secondary student of a similar level to participate.
  • Teacher’s Discretion: The teacher may determine if the secondary student’s level is not a good fit (i.e. the stated learning goal can not be accomplished with the lesson bundle) and communicate this to the primary student, who can then decide whether to continue alone or with the secondary student.

5. Get-to-Know Session

  • Requirement: All new students must book a 45-minute get-to-know session prior to their first lesson of any lesson bundle. This serves to establish the goals of any future course, to do a tech-check, and to determine mutually if it's a good fit. This session is to be paid in full before it takes place, and the student is not guaranteed future lessons afterwards.
  • Conditions: This session is non-refundable for any reason and can only be booked once per primary student. 

6. Refunds and Membership

  • Prorated Refund: Students can receive a prorated refund for unused lessons at any time for lesson bundles, excluding an administrative fee of 100EUR. The refund is calculated as follows: (Bundle Price / Total Units in Bundle) * Unused Units - 100EUR. If the amount of remaining units is worth less than 100EUR, no refund will be given. The 100EUR registration fee applies to and is included within each bundle purchased.
  • Membership: Purchasing lesson bundles grants automatic access to a 365-day membership on deutschable.com, which includes access to all self-study courses on the site. This membership remains valid even after a refund of private lessons. If students are already members of the site at purchase, the expiration date of their membership is extended to 365 days from this purchase.

7. Payment Terms

  • Payment Methods: Accepted payment methods include credit card, PayPal, Google Pay, and Apple Pay. Payments must be rendered in full before the first lesson can be scheduled, with no exceptions. Alternate forms of payment are not accepted.
  • VAT: Prices do not include VAT, if applicable. VAT is determined based on the student's address selected at checkout (e.g., Germany charges 19% VAT, while the US charges none).

8. Rescheduling and Cancellations

  • Student Rescheduling: Sessions can be rescheduled if the teacher is notified at least 24 hours in advance. Cancellations or rescheduling within 24 hours or no-shows will result in the unit being marked as used/forfeit.
  • Teacher Cancellations: If the teacher cancels, the lesson unit(s) will be rescheduled to a mutually convenient date.

9. Termination of Course

  • Unilateral Cancellation: Both the teacher and the student reserve the right to cancel the remainder of the course.
    • Teacher Cancellation: If the teacher cancels, the student will receive a prorated refund for all remaining units and the administrative fee is waived.
    • Student Cancellation: The student can receive a prorated refund for unused units minus the registration fee, as described above.

10. Usage Period

  • Validity: All units must be used within 18 months of purchase. Any units remaining after this period are void and non-refundable. Should a student not be capable of fulfilling the remainder of the units themselves, they may designate another person to take their spot (which must be communicated to the teacher in writing), irrespective of reaching any particular learning goal.

11. Commitment to Regular Meetings

  • Frequency: Both parties agree to endeavor to meet at least once a week on average to maintain learning progress.
  • Unresponsiveness: The student is entitled to a prorated refund of all unused units (with the administrative fee waived) if the teacher is unresponsive for or no lesson occurs within a four-week period despite the student's repeated efforts to contact the teacher and/or schedule a lesson. After three consecutive reschedulings by the teacher, the student may request a prorated refund with the administrative fee waived.

12. Privacy and Confidentiality

  • Data Protection: Student information will be used solely for the purpose of providing lessons and will be protected in accordance with applicable data protection laws.
  • Screen Shots: The teacher may take a screen shot of each lesson unit to prove that the lesson took place. These screenshots are kept for a period of three years unless the student specifically requests not to receive a certificate, in which case the screenshots are deleted after the course is completed or the lesson units have expired.

13. Liability

  • Disclaimer: The teacher is not liable for any technical issues or other circumstances beyond his control that may affect the lessons.

14. Governing Law and Dispute Resolution

  • Governing Law: These Terms & Conditions are governed by the laws of the Federal Republic of Germany.
  • Jurisdiction: Any disputes arising from these Terms & Conditions shall be resolved in the courts of Berlin, Germany.

15. Changes to Terms & Conditions

  • Modifications: Deutschable reserves the right to modify these Terms & Conditions. Students will be notified of any changes via email.

By purchasing and engaging in the lessons, students acknowledge and agree to these Terms & Conditions.
